Who owns the Furry Peeps creative stuff?

Unless otherwise stated, intellectual-property rights in original Furry Peeps artwork, product designs, photographs, graphics, written content, product descriptions, videos, audio, branding and other creative material are owned by or licensed to SPATZ Conceptz Pty Ltd trading as Furry Peeps.

Copyright ownership depends on the particular work and the legal arrangements under which it was created. Where Furry Peeps owns or has been assigned the relevant copyright, those rights remain with Furry Peeps unless they are expressly transferred in writing.

Some material appearing on Furry Peeps products or websites belongs to third-party artists, designers, photographers, software providers or licensors. Their rights remain theirs.

Copyright may also be recognised and protected outside Australia under applicable laws and international arrangements.

What this covers.

Depending on the material and the intellectual-property rights that apply, protected or proprietary Furry Peeps material may include:

• original pet artwork, illustrations and digital designs
• product artwork, patterns, layouts and graphic compositions
• personalised design templates and original design elements
• website graphics, icons, banners and original visual assets
• product photography, lifestyle photography and promotional images
• product descriptions, website copy, articles and original written material
• videos, animation, audio and other original media
• logos, business names, trade marks, slogans, product-range names and other brand identifiers to the extent protected by law
• packaging artwork and printed presentation materials
• original digital assets and custom code owned by Furry Peeps

What you are welcome to do.

Commercial copying is not authorised.

Unless we have given prior written permission, you must not reproduce, copy, adapt, distribute, publish, communicate, manufacture from, sell, licence or otherwise commercially exploit Furry Peeps copyright material or other protected intellectual property where doing so would infringe our rights or the rights of our licensors.

This includes using our artwork, photographs, illustrations, graphics, product descriptions or other creative material to produce competing products, marketplace listings, social-media advertisements, print-on-demand products, templates, downloads, digital files, clip art, design libraries or other commercial material.

Changing the colour, flipping an image, tracing the artwork, adding a border, changing a few words or asking software to produce a suspiciously familiar version does not magically make copying somebody else’s work a brilliant new business idea.

What buying a Furry Peeps product means.

When you purchase a physical Furry Peeps product, ownership of that physical product passes to you in the ordinary way.

The purchase does not transfer copyright, trade mark, design or other intellectual-property rights in the artwork or creative material appearing on the product.

You may use the physical product normally for its intended personal or domestic purpose.

You may not use the product as a master, template, scan, source file, manufacturing reference or reproduction sample for unauthorised commercial copying of our artwork or designs.

Some Furry Peeps products may include our logo, website address, copyright notice or other brand identifiers. Those identifiers do not create the underlying rights, and removing them does not transfer those rights.

Customer-supplied photos, artwork + wording.

Furry Peeps does not claim ownership of your photograph, logo, illustration, name, wording or other material merely because you upload or supply it to us for personalisation.

Rights in customer-supplied material remain with the customer or the relevant rights owner.

By supplying content to us for an order, you give Furry Peeps permission to use, reproduce, crop, resize, position, edit, process and otherwise handle that material as reasonably necessary to:

• create the personalised product you requested
• prepare artwork and production files
• fulfil and dispatch the order
• provide customer support relating to the order
• manage an approved reprint or replacement
• deal with related operational requirements

You are responsible for ensuring you have the rights, licences, permissions or consents needed for anything you ask us to reproduce, including photographs, business logos, illustrations, third-party artwork and other protected material.

We may decline an order if we reasonably believe supplied material infringes another person’s intellectual-property or other legal rights.

Third-party + licensed artwork.

Some designs, fonts, photographs, illustrations, graphics, characters or other creative material used by Furry Peeps may be licensed from independent artists, photographers, designers, commercial licensors or other rights owners.

Those rights remain with the relevant rights owner.

Furry Peeps’ permission to use licensed material does not give customers, competitors, retailers or website visitors permission to copy, reproduce, sublicense, manufacture from or commercially exploit that material themselves.

Third-party material appearing on the Furry Peeps website remains subject to the copyright, trade mark, licence and other rights of the relevant owner.

Commercial stockists need approval.

Retail orders placed through the Furry Peeps website are intended for normal retail purchase unless we agree otherwise.

Buying a Furry Peeps product does not appoint you as an authorised Furry Peeps reseller, distributor, wholesaler or stockist.

It also does not give you permission to copy our product photographs, descriptions, logos, website graphics, artwork or marketing assets to establish or promote a commercial resale business.

Businesses interested in stocking Furry Peeps products should contact us and obtain appropriate written approval and commercial terms.

Nothing here is intended to prohibit a lawful private resale of a genuine physical product that you personally own where applicable law permits that resale.

Trade marks + Furry Peeps branding.

The Furry Peeps name, logos, slogans, product-range names, graphic brand elements and other identifiers may be protected as registered or unregistered trade marks and through other applicable Australian laws.

A business-name registration or domain-name registration is different from a registered trade mark.

No licence to use a Furry Peeps trade mark is granted merely because you visit our website, buy a product or follow us on social media.

You must not use Furry Peeps names, logos or branding in a way likely to mislead people into believing that your business, shop, product, service, website or social account is operated by, authorised by, sponsored by, affiliated with or endorsed by Furry Peeps when it is not.

Scraping, datasets + AI use.

Except where permitted by law or expressly authorised by Furry Peeps in writing, we do not grant permission for our copyright material or protected creative content to be systematically scraped, harvested, copied or reproduced for commercial dataset creation, machine-learning training, generative-AI training, image-model training or similar automated commercial use.

This includes bulk extraction of Furry Peeps:

• artwork and illustrations
• product designs and patterns
• photographs and product imagery
• product descriptions and written copy
• graphics and original website assets
• creative product data and design collections

This includes extraction for the purpose of creating or improving commercial models, datasets, design libraries, automated content services or competing product-generation systems.

Nothing in this section attempts to prohibit conduct that cannot lawfully be restricted.

Reporting suspected infringement.

If you believe Furry Peeps content has been copied, reproduced, manufactured from or commercially used without appropriate permission, please send us enough information to investigate.

• a link or screenshot showing the suspected use
• the Furry Peeps artwork, photograph, product or content involved
• the website, marketplace account, business or person using it if known
• the approximate date you noticed it
• any other details that will help us locate the material

If you are a copyright, trade mark or other rights owner and believe material appearing on the Furry Peeps website infringes your rights, please contact us with details of the work, your rights and the material you are concerned about so we can review it.

Uses permitted by law.

Nothing in this policy is intended to prevent a use of copyright material that is permitted without permission under the Copyright Act 1968 (Cth) or another applicable law.

Australian copyright law contains exceptions and statutory licences that may permit particular uses in particular circumstances.

Whether an exception applies depends on the particular material, use and circumstances involved.

Nothing in this policy creates intellectual-property rights that do not otherwise exist or gives Furry Peeps ownership of third-party material that it does not own.

Nothing here is intended to exclude, restrict or modify consumer rights or remedies that cannot lawfully be excluded.

Copyright, trade mark, wholesale and intellectual-property permission requests must be made in writing.

Silence, tagging us on Instagram, putting “credit to owner” underneath our artwork or telling us your cousin said it was fine does not amount to written permission.

If we do grant permission, that permission applies only to the particular use, material and conditions we agree to.
